Definition : Trademark, is an indicator formed of every kind of sign, word, number, person’s name used for the separation of the goods and service of an enterprise from another. There is no relation between the register at the Turkish Patent Institute and the name-title register at the Trade Registry Directorate of the mark. The register provides no protection the protection may be extended as desired for the periods of 10 years. Procedure : First step in Trademark Registration is the preparation of the print of mark. It could be with or without logo. Print of the mark has to be prepared as how it is intended to be used. In second step, class of the registration is specified. For this, International NICE Classification System is used. Trademark search is prosecuted as a third step. It is necessary to prosecute trademark search in order to avoid wasting time and money due to the prior application or registration. Trademark search could be prosecuted both in our firm’s database and in Turkish Patent Institute Official database. Then, application is prepared and filed to Turkish Patent Institute. Office examines the application and if there is no obstacle according to law 556(7) and (8), application is published. There is 3 months opposition period from the date of publication.
