Definition
: Patent is an original invention, which exceeds
the known limits of the technology and is applicable to the industry
and not represented to the public before. The protection period
is 20 years for patents with examination. If it is not examined,
protection period is 7 years. Utility model is a new small invention,
which is applicable to industry but not exceeding the known limits
of the technology. The protection period is 10 years.
Procedure
: For an invention to be patentable, it should
not be a chemical production or method. First of all, technical
drawings have to be prepared. Drawings are not detailed and measures
are not used. It is enough to tell the system of the invention
and indicate the numbers of the related parts. As a second step,
specification of the invention, which explains the invention in
details and refers to the drawings, is prepared. In specification,
technological problems and the solution to these problems, which
is realized by the invention, are stated. Explaining all qualifications
of the invention and telling the alternatives (if there are) are
very important. Claims are prepared in third step. Claims state
the qualifications of the invention as short and clear as possible
without referring to drawings and exceeding matters in specification.
Claims do not state the aim or result but qualifications of the
invention. Finally, summary of the invention not longer than 100
words is prepared to be published in bulletin. All of the prepared
documents are filed to Turkish Patent Institute. Institute examines
the summary, specification and claims under the law 551. Then,
it has technology’s known level search via its partner patent
offices. In other words, it is searched that whether there is
a similar or identical invention, whether it is known or at which
level the technology is in this field. Following, invention is
published by institute. It takes approximately 24-28 months to
complete all these procedures.
