     International Patent Applications and Fees

     EUROPEAN PATENT CONVENTION (EPC)

     European Patent Convention is a system that includes 24 countries, and Turkey has joined in this system in November 2000. Countries included in this system are: Germany, Austria, Belgium, Bulgaria, Czech Republic, Denmark, Estonia, Finland, France, Cyprus, Netherlands, England, Ireland, Spain, Sweden, Switzerland, Italy, Liechtenstein, Luxemburg, Monaco, Portuguese, Slovakia, Turkey and Greece. Any or all of these countries could be chosen for application.

     Requirements :
     - English translation of patent description.
     - Receipt showing the application and European Research fees are paid.
     - EPC application petition
     - Declaration of inventor
     - Power of attorney

     How System Works,
    - Application could be submitted either through Turkish Patent Institute or through the Bureau of European Patent Office in Munich.
- During the application no choice of countries is made. After the research is completed countries are chosen. If more than 7 countries chosen no fee is paid for the countries after 7.
- Application submitted to Turkish Patent Institute, is sent to EPO after a preliminary examination is made. After making a preliminary examination, EPO makes a research about known limits of technology and after preparing a report about research, EPO issues the application together with the report within 18 month after the application is submitted.
- Request for examination must be made within 6 month after the date of issue.
-After the issue, national step of the application starts by finding an attorney in each of chosen countries. Later on each county’s own procedure is followed.

     Fees:

     BASIC FEE...................................................................... 125 EURO
     EUROPEAN RESEARCH FEE........................................ 690 EURO
     ENTRANCE FEE FOR COUNTRÝES.............................. 75 EURO
     INTERNATIONAL RESEARCH FEE.............................. 945 EURO
     EXAMINATION FEE.................................................... 1.430 EURO
     * Not paid above 7 countries.

     Patent Cooperation Treaty (PCT)

     Patent Cooperation Treaty is a system that includes 115 countries all over the world and Turkey is one of its members since January 1996..

     Requirements:
     - English translation of patent description.
     - Receipt showing the application and European Research fees are paid.
     - EPC application petition
     - Research petition (Optional)

     How System Works:
     - Application could be submitted either through the Turkish Patent Institute or to EPO or WIPO.
- Country fee is not paid for the countries above 5.
- Application submitted to Turkish Patent Institute, is sent to EPO after a preliminary examination is made. After making a preliminary examination, EPO makes a research about known limits of technology and send a report to applicant. And the applicant express whether he wants an examination or not.
- International bureau issues the application and the research report within 18 months after the application submitted.
- After the issue national step of the application starts by finding an attorney in each of chosen countries. Later on each county’s own procedure is followed.
