Turkish
Patent Institute performs trademark searches. However, Turkish
Patent Institute requires fees for each trademark. Therefore,
it is advisable to apply patent and trademark offices which prosecute
trademark searches without charging.
Who
can file trademark application?
Holder
of the mark or trademark attorneys authorized by Turkish Patent
Institute can file trademark registration. For this reason, it
has to be asked to person or trademark attorney whom would like
to have trademark application whether he/she has official attorney
certificate.
How
long could registration protect your trademark?
Trademark
registration could protect your mark for 10 years period. It can
be extended 10 years. If renewal is filed 6 months before the
deadline, Turkish Patent Institute requires lower fees. If the
deadline is missed, renewals could be done in 6 months time but
official fees are increased. If it is not renewed in time, trademark
is abandoned and could be registered by another person.
What
happens if the trademark is not registered?
Not
having trademark registration could cause some penal and legal
sanctions as well as some commercial risks. It could be must to
change a mark, which has been used for long years.
What
are the results of using a registered trademark?
Using
a registered trademark could cause imprisonment sentences from
2 years to 4 years and fine sentences, collection of goods from
markets, and payment of compensations. Penal and law sanctions
are depend on complain of the holder of the trademar.
