The Continuance of Patent / Utility Model

Payment of the annual fees

The annual fees of the patent/utility model applications should be paid each year on the same day with the application date. The non-payment of the annual fees causes the invalidity of the Patent/Utility Model.

Terms of Protection

• The examined patent certificates are valid for 20 years in Turkey, starting from the application date.
• The unexamined patent certificates are valid for 7 years in Turkey, starting from the application date.
• The utility model certificates are valid for 10 years starting from the application date.

The usage necessity of the Patent/Utility Model

The Patent/Utility Model owner or the person authorized by him/her, should use the invention that is protected with patent/utility model. The usage necessity should be realized within three years starting from the publication of the grant of the patent. In the evaluation of the usage, the market conditions are taken into consideration. The proof of usage; the patent owner or the person authorized by him/her proves the Institute that the invention is being used by presenting an official document. The official patent usage certificate should be issued by the authority and according to the general criteria and rules determined in the Regulations. The Certificate of Use is given at the end of the examination of production that is produced at the industrial enterprise. The certificate confirms the sole or the usage of the patented invention. The document is arranged by the related authority within three months following the date of its application. The certificate contains information concerning the active usage of the patented invention. The Certificate of Use is recorded to the Patent Registry. The non-usage of the Patent/Utility Model causes compulsary license
